Villkor för deltagande
Behörighet att utöva yrkesverksamheten:

1. The supplier shall fulfill the following requirements according to the act of public procurement SFS 2016:1146 chapter 13 § 3;

(a) has not committed a violation of applicable obligations referred to in the fields of environmental, social and labour law established by Union law, national law, collective agreements or by the international environmental, social and labour law.

(b) is not bankrupt or is not the subject of insolvency or winding-up proceedings, where its assets are not being administered by a liquidator or by the court, where it is not in an arrangement with creditors, where its business activities are not suspended or it is not in any analogous situation arising from a similar procedure under national laws and regulations;

(d) has not entered into agreements with other economic operators aimed at distorting competition;

(e) where a conflict of interest arising in the conduct of procurement procedures so as to avoid any distortion of competition and to ensure equal treatment of all economic operators cannot be effectively remedied by other less intrusive measures;

(f) where a distortion of competition from the prior involvement of the economic operators in the preparation of the procurement procedure, as referred to in Chapter 4 §7, cannot be remedied by other, less intrusive measures;

(g) has not shown significant or persistent deficiencies in the performance of a substantive requirement under a prior public contract, a prior contract with a contracting entity or a prior concession contract which led to early termination of that prior contract, damages or other comparable sanctions;

(h) has not been guilty of serious misrepresentation in supplying the information required for the verification of the absence of grounds for exclusion or the fulfilment of the selection criteria, has not withheld such information or is not able to submit the supporting documents required pursuant to Chapter 14 3 §; or

(i) has not undertaken to unduly influence the decision-making process of the contracting authority, to obtain confidential information that may confer upon it undue advantages in the procurement procedure or to negligently provide misleading information that may have a material influence on decisions concerning exclusion, selection or award.

2. Adequate financial and economical strength in relation to the scope of the contract. Minimum annual turnover last 3 years MSEK 30 to 40. Fortum reserves the right to make a credit control.

3. Documented technical capacity.

Teknisk och yrkesmässig förmåga:

Three valid references of similar supplies, not older than 3 years should be submitted including name of client, time of delivery, and clients contact details.

With regard to criteria relating to economic and financial standing and all selection criteria relating to technical and professional ability, candidates may rely on the capacities of other entities. While relying on the capacities of other entities the candidates shall prove to the contracting authority that it will have at its disposal the resources necessary, for example, by producing a commitment by those entities to that effect e.g. written agreement, bank guarantee, parent company guarantee.
